1. Our Services
Digitality provides website design and development, Google Ads management, Meta Ads management, and related digital marketing services.
The specific deliverables, fees, timelines, and responsibilities for each project will be set out in a written proposal or service agreement. If that agreement conflicts with these general terms, the project agreement takes priority.
2. Using Our Website
You must not misuse our website, attempt unauthorised access, upload harmful content, or use our content in a way that infringes another person’s rights.
Submitting an enquiry does not create a service agreement or reserve a project start date.
3. Proposals and Project Scope
Work begins after acceptance of the written proposal and receipt of any agreed initial payment.
Only the services and deliverables listed in the accepted proposal are included. Additional pages, features, campaigns, or other requests may require a separate quotation and revised timeline.
4. Client Responsibilities
Clients are responsible for providing accurate information, project materials, necessary permissions, and timely feedback.
You confirm that you have the right to use any text, images, trademarks, customer information, or other materials supplied to us.
Delays in providing materials, access, approvals, or payments may affect delivery dates.
5. Fees and Payments
Fees, payment schedules, currencies, and any applicable taxes will be stated in the proposal or invoice.
Unless expressly included, our fees do not cover advertising spend, domains, hosting, paid software, stock assets, or other third-party charges.
If a payment is overdue, we may pause work after notifying you. Any resulting timeline changes will be communicated.
6. Revisions and Approvals
The number and scope of included revisions will be stated in the proposal.
A change to an approved direction or a request outside the agreed scope may involve additional fees. Clients are responsible for reviewing and approving content and deliverables before publication or launch.
7. Timelines
Project timelines depend on the agreed scope, timely client input, and the availability of third-party services.
We will communicate material delays and discuss any necessary adjustments.
8. Advertising and Marketing Results
Advertising performance depends on factors such as budget, competition, audience, pricing, website quality, and platform decisions.
We do not guarantee a particular number of leads, sales, search rankings, revenue, or return on advertising spend.
Advertising platforms independently control ad approvals, account restrictions, delivery, and policy enforcement.
9. Intellectual Property
Ownership and licensing arrangements will be stated in the project agreement.
Unless otherwise agreed, ownership of final custom deliverables created specifically for the client transfers after full payment. Our existing tools, reusable components, working methods, and third-party materials remain subject to their respective ownership and licence terms.
Portfolio use of client work will be subject to any agreed permission and confidentiality requirements.
10. Third-Party Services
Projects may depend on external services, including hosting, plugins, advertising platforms, and payment gateways.
Those services have their own terms, fees, and limitations. Changes, outages, or restrictions affecting them may require additional work outside the original scope.
11. Support and Maintenance
Ongoing maintenance, backups, updates, content changes, and campaign management are included only where stated in the service agreement.
Any post-launch support period and its coverage will be confirmed in writing.
12. Cancellation and Refunds
Cancellation terms will follow the accepted proposal or service agreement.
If no specific cancellation arrangement exists, we will assess fees for work completed and unavoidable third-party commitments, then provide a written breakdown of any balance due or refund.
Nothing in these terms removes any mandatory cancellation or refund rights under applicable law.
13. Confidentiality and Privacy
Each party will protect confidential information received during a project, except where disclosure is authorised, needed for agreed service delivery, or required by law.
Our handling of personal information is described in our Privacy Policy and any applicable data processing agreement.
14. Liability
Each party’s responsibilities and any agreed limits of liability should be set out in the project agreement.
Nothing in these terms excludes or limits liability where doing so would be unlawful, or removes rights that cannot legally be waived.
15. Disputes and Applicable Law
Please contact us first so we can try to resolve any concern.
The project agreement will specify the applicable law and dispute arrangements. Any such arrangement remains subject to mandatory legal protections.
16. Changes to These Terms
We may update these terms for future website use and future engagements. Updates will not automatically change an existing signed agreement.
